Below are the full terms and conditions for the Lokseva Welfare Trust. The document was drawn up by Lokseva Welfare Trustís legal specialists and we have been advised to place it on our website. While this document may look frightening, most of the terms and conditions exist to protect you (for example, to give assurances about how we will handle the information you give to us) and to protect Lokseva Welfare Trust(for example, if people attempt to defraud Lokseva Welfare Trust through this scheme).
The parties under these terms and conditions are Lokseva Welfare Trust and the donor. When the donor makes a donation on these terms and conditions, Lokseva Welfare Trust will hold the money on trust for the donor. The terms of the trust depend on whether the donation is made for allocation to a Lokseva Welfare Trust project (as described below) or for Lokseva Welfare Trustís general charitable purposes. When the donor makes a donation for a project a contract is formed on these terms and conditions, under which Lokseva Welfare Trust must supply a voucher for the donor.
Lokseva Welfare Trust is a Trust registered in India with number E-5123(Thane) dated 30-01-2009. Lokseva Welfare Trustís Registered Address is Lokseva Welfare Trust, Shanti Nagar, Mira Road (E). Thane - 401107. The donor is the person who makes any donation to Lokseva Welfare Trust as part of the Lokseva Welfare Trust,to which these terms and conditions will apply.
The Tax exemption is a document supplied by Lokseva Welfare Trust in printed or electronic format that contains a unique reference number for each donation made by the donor for Lokseva Welfare Trust projects. Lokseva Welfare Trust will not supply any voucher for any other donation made as part of the Lokseva Welfare Trust.
Lokseva Welfare Trust projects
A Lokseva Welfare Trust project is any project promoted by Lokseva Welfare Trust as being part of the Lokseva Welfare Trust. Lokseva Welfare Trust reserves the right to include any project at any time and to withdraw any project at any time. This is because each projectís funding requirements are set by Lokseva Welfare Trust in advance, and if a project achieves its required funding no further donations are required.
Payment of donations
Donations sent to Lokseva Welfare Trust by post must be made by a valid cheque drawn on an account in the donorís name. Donations submitted to Lokseva Welfare Trust online or by telephone must be made by a valid debit/credit card/net banking held by the donor for a account in the donorís name.
Amount of donations for Lokseva Welfare Trust projects
Lokseva Welfare Trust invites donations for Lokseva Welfare Trust projects of any amount within the range from Rs. 10,000/- onwards upto Rs. 20,00,000/-. A given donation must be for the sum of the fixed amounts pledged by the donor in the order form submitted to Lokseva Welfare Trust. If the donorís donation exceeds the sum required Lokseva Welfare Trust will treat the surplus as being a donation for Lokseva Welfare Trustís general charitable objects and not a donation to be allocated to any Lokseva Welfare Trust project.
The amount of the donorís donation to Lokseva Welfare Trust will not be printed on the voucher or accompanying documentation.
Donations for Lokseva Welfare Trust
In the case of each donation made by the donor to be allocated to any Lokseva Welfare Trust project, Lokseva Welfare Trust will hold the donation in a holding account, on trust for Lokseva Welfare Trustís general charitable purposes. For pending allocation Lokseva Welfare Trust may hold the donation in the holding account but may not use those funds in any other way.
Lokseva Welfare Trust will use tax reclaimed under the Gift Aid scheme relating to Lokseva Welfare Trust donations for any purpose within Lokseva Welfare Trustís charitable objects, including its administrative costs and expenses in providing the Lokseva Welfare Trust.
Delivery and security of the Tax Exemption certificates:
Lokseva Welfare Trust dispatch the Tax Exemption certificate and Annual Reports to the donor on request. It is the donorís responsibility to intimate, postal service providers if there is a problem with dispatch.
Lokseva Welfare Trust will use reasonable effort to deliver Tax exemption certificates within the timescales it publishes from time to time. Lokseva Welfare Trust cannot guarantee delivery within its published timescales and recommends that donors make use of any electronic delivery methods offered by Lokseva Welfare Trust instead of the post to avoid disappointment.
Lokseva Welfare Trust may use any postal carrier or e-mail provider to deliver Tax exemption Certificate. Lokseva Welfare Trust will decide in its absolute discretion what delivery methods, such as post or e-mail; it will offer from time to time to send the vouchers. The donorís choice of delivery method, once made, may not be changed.
Lokseva Welfare Trust will forward the Tax Exemption to the name and address supplied by the donor as part of the process of making the donation. It is the donorís responsibility to ensure the name and addresses provided to Lokseva Welfare Trust are correct.
Tax Exemption in transit
For exemption delivered by post, Lokseva Welfare Trust will dispatch in a reasonably strong sealed envelope. By e-mail Lokseva Welfare Trust will dispatch the certificate from its own registered email ids. Lokseva Welfare Trust will not be responsible if any envelope becomes opened in transit, or any transmission is intercepted or otherwise made available to or accessed by someone other than the addressee, unless due to the negligence of Lokseva Welfare Trust or its employees or other delegates. Lokseva Welfare Trust will not be responsible for any act or omission of any postal or internet service provider or its staff.
Anyone who has access to the voucher or the unique reference number on a voucher will be able to allocate the donorís donation to a Lokseva Welfare Trust project. From the time the voucher is delivered by Lokseva Welfare Trust it is the responsibility of the donor and any other voucher holder to keep the voucher and the unique reference number on it safe and secure.
Lokseva Welfare Trust ís powers as trustee
Lokseva Welfare Trust may exercise any of the following powers in relation to donations made as part of the Lokseva Welfare Trust. Power to invest donations in any way and use the income for the purposes chosen by the donor under these terms and conditions. Power to put donations to Lokseva Welfare Trustís general charitable purposes, or the tax reclaimed under the Gift Aid scheme in relation to donations, towards the cost of its employees who operate the Lokseva Welfare Trust or the cost of other delegates.
Before making a donation the donor must consent to Lokseva Welfare Trust using the donorís own personal data. Lokseva Welfare Trust will only use the donorís personal details within the terms of that consent.
The donor may supply another personís personal details to Lokseva Welfare Trust as part of the Lokseva Welfare Trust. Those details will be used by Lokseva Welfare Trust for purposes published by it on its website or the printed catalogue for the scheme. Lokseva Welfare Trust relies on the donor to ensure the donor is fairly and lawfully able to pass those details to Lokseva Welfare Trust for those purposes. Lokseva Welfare Trust agrees not to process the other personís details except in accordance with the donorís instructions.
Lokseva Welfare Trust will maintain appropriate technical and organizational measures against unauthorized or unlawful processing of personal data and against accidental loss or destruction of, or damage to, personal data. Complaints and disputes
If the donor has any complaint about the Lokseva Welfare Trust, Lokseva Welfare Trust or its delegates they may complain in writing or by e-mail to the given email id on Lokseva Welfare Trustís website or by telephone using the number given in those places.
If any dispute arises between Lokseva Welfare Trust and the donor in connection with the Lokseva Welfare Trust, the parties to the dispute will attempt to settle it in good faith, initially by written or telephone correspondence. If that fails then at either partyís request the parties will settle the dispute by mediation.Unless otherwise agreed between the parties, the mediator will be nominated by Lokseva Welfare Trust Chairman
Neither Lokseva Welfare Trust nor the donor may issue court proceedings or pursue arbitration until the parties have exhausted the complaints and dispute resolution processes as mentioned above. If any court proceedings has to happen will be only under the Thane Jurisdiction.
Donations to the Lokseva Welfare Trust is available to all human beings without Caste and Creed its open to all.
If any provision of these terms and conditions is found to be invalid, illegal or unenforceable, that provision will, to the extent required, be deemed not to form part of these terms and conditions and the validity and enforceability of the other provisions of these terms and conditions will not be affected. The terms and Conditions is formed in such a way The Trust should not be affected which can lead benefits to the neediest publics without any Caste & Creed.
The Lokseva Welfare Trust, these terms and conditions and each donation made on these terms and conditions will be governed by the law of Indian Trust Act. These terms and conditions will be interpreted in accordance with the law of the Indian Trust Act. The courts of Thane in India will have non-exclusive jurisdiction.
Since, the payment is accepted as a donation, no cancellation is accepted. However, if the user has made multiple transaction due to error, it can be cancelled and the donation amount will be refunded to the same person's/company's account.
